HS Code for Plastic Toys in India: Classification, BIS Toy QCO and Duty

By Abhishek Sadashiv ยท 16 years of experience in global logistics ยท Updated 5 October 2026 ยท 5 min read

Usual HS code for plastic toys (import)

9503 00

Toys go to heading 9503 by what they are, not what they're made of. The last two digits depend on whether the toy is electronic.

Plastic toys are one of the most common first imports for small sellers in India. Building blocks, toy kitchens, dolls, pull-along cars: they're light, they sell well on Amazon and Flipkart, and Chinese suppliers have endless catalogues.

But toys are also one of the products where I see importers get burnt most often, not on the HS code but on BIS. Get both right before you pay the supplier's advance.

The usual HS code: 9503 00

LevelCodeDescription
Chapter95Toys, games and sports requisites
Heading9503Wheeled toys, dolls, other toys, scale models, puzzles
Subheading9503 00All of the above (one subheading)
Tariff item9503 00 xxSplit in India's tariff, mainly electronic vs non-electronic toys, and parts

The reasoning is simple: a toy is classified as a toy. Heading 9503 covers toys of any material, plastic, wood, metal or fabric. The material only matters if the article isn't really a toy at all.

India's tariff splits 9503 00 into separate 8-digit lines, and the main question is whether the toy is electronic or not. That's why I'm giving you six digits here. A plain plastic block set and a battery-operated talking doll sit under the same heading but on different tariff lines, and the duty treatment can differ.

Why not 3926 90 (other articles of plastics)?

This is the classic mistake. A supplier's invoice says "plastic product" or the HS code on their export declaration is 3926 90, and the importer just copies it. But Chapter 39 notes exclude articles of Chapter 95. If it's designed for children to play with, it's a toy, not a "plastic article".

Customs knows this too. Using 3926 for toys looks like an attempt to dodge both the toy duty line and the BIS Toys QCO, and that's not a conversation you want at Nhava Sheva.

The other mix-ups I see: 9504 (that's for games, playing cards and video game consoles) and 9505 (festive and carnival articles like Christmas decorations).

What decides the final code

  • Electronic or not: any electronic function (lights, sounds, motors with circuits) usually moves it to the electronic toys line.
  • Toy or game: board games and card games go to 9504, not 9503.
  • Parts and accessories imported separately have their own lines under 9503 00.
  • Who it's for: a scale model for adult collectors still goes under 9503, but sports goods (9506) and festive items (9505) don't.
  • Sets: a toy sold with a non-toy item is classified by its essential character.

How import duty is worked out

Duty is calculated on the assessable value (CIF in rupees): Basic Customs Duty, then the Social Welfare Surcharge on that duty, then IGST on the total. Toy duty in India has been raised sharply in recent years to push local manufacturing, and the electronic and non-electronic lines don't always carry the same IGST, so check the current rate for your exact tariff line before you price your product.

Run your toy through a lookup, or put your numbers in the free import duty calculator. For pricing on a marketplace, the landed cost calculator adds freight, CHA and other charges.

Compliance checklist for plastic toys

RequirementStatusWhat it means
BIS Toys QCO (ISI mark)๐Ÿ”ด MandatoryToys for children under 14 come under the Toys (Quality Control) Order. The foreign factory needs its own BIS licence, and each toy must carry the ISI mark. Non-electric toys are tested to IS 9873.
IS 15644 (electric toys)๐ŸŸ  CheckIf the toy has batteries, lights or motors, it also falls under the electric toys standard.
Legal Metrology๐Ÿ”ด For retail packsImporter name and address, MRP, net quantity, month and year of import, and customer care details on the pack.
Plastic packaging EPR๐ŸŸ  CheckImporters of packaged goods may need EPR registration with CPCB under the Plastic Waste Management Rules.
Battery EPR๐ŸŸ  CheckOnly if batteries are supplied with the toy.

๐Ÿ”ด Mandatory ยท ๐ŸŸ  Check ยท ๐ŸŸข Not required

Mistakes that cost importers money

  • Copying 3926 90 from the supplier's invoice because the toy is made of plastic.
  • Ordering from a factory without a BIS licence. Ask for the licence number and check it on the BIS website before paying anything.
  • Assuming the licence covers every model. New designs may need to be added to the licence.
  • Missing the ISI mark on the product or pack even though the factory holds a licence.

My advice

With toys, start from the BIS licence, not the price. A cheap supplier without a valid licence is no deal at all, because the shipment can't be cleared. Once you've found a licensed factory, check the exact tariff line for your toy with a lookup, and then do your costing.
